Principle of Uberrimae fidei (Utmost Good Faith) Principle of Uberrimae fidei (a Latin phrase), or in simple english words, the Principle of Utmost Good Faith, is a very basic and first primary principle of insurance. According to this principle, the insurance contract must be signed by both parties (i.e insurer and insured) in an absolute good faith or belief or trust. The person getting insured must willingly disclose and surrender to the insurer his complete true information regarding the subject matter of insurance. The insurers liability gets void (i.e legally revoked or cancelled) if any facts, about the subject matter of insurance are either omitted, hidden, falsified or presented in a wrong manner by the insured. The principle of Uberrimae fidei applies to all types of insurance contracts. 2. Principle of Insurable Interest The principle of insurable interest states that the person getting insured must have insurable interest in the object of insurance. A person has an insurable interest when the physical existence of the insured object gives him some gain but its non-existence will give him a loss. In simple words, the insured person must suffer some financial loss by the damage of the insured object. For example :- The owner of a taxicab has insurable interest in the taxicab because he is getting income from it. But, if he sells it, he will not have an insurable interest left in that taxicab. Principle of Indemnity Indemnity means security, protection and compensation given against damage, loss or injury. According to the principle of indemnity, an insurance contract is signed only for getting protection against unpredicted financial losses arising due to future uncertainties. Insurance contract is not made for making profit else its sole purpose is to give compensation in case of any damage or loss. In an insurance contract, the amount of compensations paid is in proportion to the incurred losses. The amount of compensations is limited to the amount assured or the actual losses, whichever is less. The compensation must not be less or more than the actual damage. Compensation is not paid if the specified loss does not happen due to a particular reason during a specific time period. Thus, insurance is only for giving protection against losses and not for making profit. However, in case of life insurance, the principle of indemnity does not apply because the value of human life cannot be measured in terms of money. 4. Principle of Contribution Principle of Contribution is a corollary of the principle of indemnity. It applies to all contracts of indemnity, if the insured has taken out more than one policy on the same subject matter. According to this principle, the insured can claim the compensation only to the extent of actual loss either from all insurers or from any one insurer. If one insurer pays full compensation then that insurer can claim proportionate claim from the other insurers. For example :- Mr. John insures his property worth $ 100,000 with two insurers AIG Ltd. for $ 90,000 and MetLife Ltd. for $ 60,000. Johns actual property destroyed is worth $ 60,000, then Mr. John can claim the full loss of $ 60,000 either from AIG Ltd. or MetLife Ltd., or he can claim $ 36,000 from AIG Ltd. and $ 24,000 from Metlife Ltd. So, if the insured claims full amount of compensation from one insurer then he cannot claim the same compensation from other insurer and make a profit. Secondly, if one insurance company pays the full c ompensation then it can recover the proportionate contribution from the other insurance company. 5. Principle of Subrogation Subrogation means substituting one creditor for another. Principle of Subrogation is an extension and another corollary of the principle of indemnity. It also applies to all contracts of indemnity. According to the principle of subrogation, when the insured is compensated for the losses due to damage to his insured property, then the ownership right of such property shifts to the insurer. This principle is applicable only when the damaged property has any value after the event causing the damage. The insurer can benefit out of subrogation rights only to the extent of the amount he has paid to the insured as compensation. For example :- Mr. John insures his house for $ 1 million. The house is totally destroyed by the negligence of his neighbour Mr.Tom. The insurance company shall settle the claim of Mr. John for $ 1 million. At the same time, it can file a law suit against Mr.Tom for $ 1.2 million, the market value of the house. If insurance company wins the case and collects $ 1.2 mi llion from Mr. Tom, then the insurance company will retain $ 1 million (which it has already paid to Mr. John) plus other expenses such as court fees. The balance amount, if any will be given to Mr. John, the insured. 6. Principle of Loss Minimization According to the Principle of Loss Minimization, insured must always try his level best to minimize the loss of his insured property, in case of uncertain events like a fire outbreak or blast, etc. The insured must take all possible measures and necessary steps to control and reduce the losses in such a scenario. The insured must not neglect and behave irresponsibly during such events just because the property is insured. Hence it is a responsibility of the insured to protect his insured property and avoid further losses. For example :- Assume, Mr. Johns house is set on fire due to an electric short-circuit. In this tragic scenario, Mr. John must try his level best to stop fire by all possible means, like first calling nearest fire department office, asking neighbours for emergency fire extinguishers, etc. He must not remain inactive and watch his house burning hoping, Why should I worry? Later, he is reminded by other immigrants that he can doubt all he wants, but remember how much money the people in his village saved to send him to this golden mountain (Lee 16). At that point he realises the moral obligation towards the villagers and prepares himself for the sacrifices he will need to make. Therefore, he picked up any work that came knocking i.e. cleaning at a tailor store. To deceive himself he would say, â€Å"As long as I can send money home, that’s enough for me† (Lee 29). For Seid Quan, leaving home meant an opportunity, a chance to end poverty for his family and the villagers back in China but at the cost of being lonely. Not only was he lonely from leaving everyone he knew behind; he never got the sense of belonging in Canada even after working hard, â€Å"They are not citizens and they do not vote, so, like the ge neration before them who died, weathered and forgotten, on the cold rail lines, their suffering is barely noticed† (Lee 44). For Pon Man, leaving home wasn’t a choice; rather it was imposed on him by his parents. Even though it wasn’t his preference, he had high ambitions and expectations from Vancouver, Canada. On the contrary, his dreams start to tremble since the very first day as he says to his father, â€Å"I don’t see anything worth money here, just a room we have to share.† Disregarding the fact that Pon Man grew a teenager without even seeing his dad, he did not like his father for plenty of other reasons. For example, he loves to draw on the sketchbook which was a go away present from his mom but according to Seid Quan, â€Å"this drawing is a waste of time, time that could be spent on working hard and helping me save.†(Lee 87) Secondly, he never liked working at the barber shop which his father owned, â€Å"Pon Man gagged whenever he had to touch the wet clumps of hair that gathered in the corners of the shop and collected in the sinks.† (Lee 75). He did not like that his life was totally governed by his dad every step of the way. However, he clearly remembers his obligations towards his dad from his mother saying, â€Å"You must do what your father tells you, even if you don’t like it or don’t want to do it†¦. He’s your father and deserves your obedience.† (Lee 80) Thus, leaving home for Pon Man not only meant leaving China where he lived for the first fifteen years of his life but also breaking free from the invisible shackles that bound his dreams and ambitions to his father. Home for Samantha was something she was frightened of, as she says, â€Å"But really I am simply afraid†¦ with my mother’s footsteps coming up quick behind me, I know that I have irrevocably returned† (Lee 3). Samantha’s mother Siu Sang was very controlling of her daughters and would expect nothing but perfection as it is evident when she starts throwing the dishes (with the smallest speck of g rease) just cleaned by her young daughters. She was obligated to listen to everything her mom asks, especially coming from a Chinese background. For a period of six years she had enjoyed the freedom from her family, escaping to Montreal for studying. However she had to sacrifice her freedom and come back due to her elder sister, Penny, getting married. She looks at Penny’s face and observes, â€Å"†¦ the loosening of the muscles around her eyes and mouth. I wonder if I looked the same when I left Vancouver for Montreal six years ago, delirious with the kind of happiness only escape can bring.† (Lee 6) She realizes that her obligations for her family have made her come back to the very place which she thought she has left for good. Thus, leaving home for her meant escaping from Vancouver, escaping from her mother – towards her freedom. Leaving home for Seid Quan and Pon Man meant similar sacrifices and obligations; however, the small differences in their ideologies created a massive communication gap between the father and son. As Seid Quan tries to make his son understand the reason for coming to Canada, he elaborates saying, â€Å"There’s no money to be made in the village, just remember that† (Lee 74). He explains the hardships back home and the importance of money. However, he contradicts himself by saying, â€Å"It’s not about expensive things. It’s about hard work and saving and supporting a family† (Lee 74). Even after working in Vancouver’s Chinatown for many years, Seid Quan wonders, â€Å"if he will ever go home for good, or if he will always be stuck in this land that shimmers with rain and is not quite dream, not quite day.† (Lee 39) He wants t o go back home but again he thinks of bringing his family over as he says, â€Å"†¦we could have built something here, lived in a house, walked through Stanley Park together.† (Lee 45) Regardless of their differences, Pon Man was like his father in a few ways, always thinking dually and that life in China was better. For example after observing the place where him and his father will be staying he says, â€Å"Our house in the village was nicer, and it didn’t smell so mouldy.† (Lee 74) He also reflects that everyone, like him, wants to escape this city, for despite the trees and mountains and pure water, Vancouver is as cold and hard at its core as anywhere else in Canada. Even though he thinks of going back and the harsh conditions life threw at him, he stays in Canada, works hard in the morning and studies in evening to become an accountant, in which he finally succeeds and moves out of Chinatown. Both father and son lived their lives in parallel lines; however they could not communicate to each other as Shew Lin, wife of Seid Quan says, â€Å"her son and husband, two men who have barely said a dozen words to each other in the last year†¦Ã¢â‚¬  (Lee 166). They never learnt to express their feelings and had to keep their inner desires hidden, unspoken, forgotten but not forgi ven. It is apparent, when Pon Man thinks he needs to be forgiven by his father, whom he despised all throughout his life, â€Å"†¦ he knows he needs to be forgiven for something, but what?† (Lee 218). In addition, Seid Quan also wanted something similar as he thought, â€Å"it was beyond him, to imagine the things he would want to say to his son, the kinds of things, he would want to ask forgiveness for (Lee 239). Thus, the very notion of cognitive dissonance is vivid throughout both their lives. On the other hand Seid Quan barely spoke with his youngest granddaughter Samantha; not because of their gap in generation but rather less because both of them were not the talkative type. After all it is repeated over and over again, how less they speak about something that actually matters as it would not make any difference to what will actually happen. It always came down to what was needed; not for the individual but for the entire family. Besides their unspoken similarities, both shared an unbound connection to their birthplace. Seid Quan always wanted to go back to China after his debts were paid off instead of bringing the family over and Samantha always wanted to leave Vancouver but leaving this place was like leaving herself. (Lee 11). In addition, it was through finding of Seid Quan’s cigarette tin, Samantha unearth a lot about her grandfather as she found the Head Tax certificate (Lee 5). In comparison, both lives of Pon Man and Samantha were governed by Seid Quan and Siu Sang respectively. Both father and daughter were under their control and always sacrificing for the family in order to meet their obligations. For Pon Man, it meant giving up art and not pursuing education after high school. Not only his dreams had to be sacrificed, he also had to work in the barbershop against his will (Lee 75, 86-87). Along the same line, Samantha had to leave Montreal and come back to Vancouver and take the responsibilities of her mother; thus sacrificing her freedom and her love affair with Matt. Both Pon Man and Samantha take defiance as their only way to revolt against their over controlled lives. Pon Man disobeys Seid Quan and goes smoking with his high school friends (Lee 81) and Samantha defies her mother by going around and having rough consensual intercourse casually. However, both father and daughter pay a price for their defiance. Pon Man gets cancer from smoking which leads to his death and Samantha wakes up from a night’s sexual encounter with a pool of blood on her bed and a visit to the hospital (Lee 154,180). Maybe it was karma or just a co-incidence but nonetheless they both had to pay for their actions. The very essence of cognitive dissonance is prominent between Seid Quan, Pon Man and Samantha in Jen Sookfong Lee’s The End of the East. Duality guided their daily lives, always having to surrender their inner desires to meet the obligations required by their family. Since none of the characters could have a firm grip on their own identities, they always suffered from expressing their feelings, even to the ones closest to them. Thus, it caused the three generations to not be able to communicate with each other past their self identity crisis.

Formalist Criticism Of Shine Essays - English-language Films, Films Formalist Criticism Of Shine Kelly Culbertson, Carnegie Mellon Univ, Pittsburgh SHINE Directed by Scott Hicks, the drama Shine is a formalist masterpiece. Writing the piece as a fiction film gave the author license to alter the events in the story of David Helfgott, a real musician who had a nervous breakdown on his way to magnificence. Geoffrey Rush's portrayal gave life and believability to David, and Rush won an Academy Award for his realistic method acting. He had not only to provide depth to the character, but had additional physical demands placed upon him due to David's irregular speech and his tendency to twitch. Both setting and costume are unobtrusive, allowing the audience to focus on the characters rather than their adornments. The formalistic style allows for manipulation of time, and the film begins in medias reas, jumping back and then foreward as it progresses. The structure is highly fragmented, and much of the action is cyclical. Every element of film composition is elegantly intertwined in this picture, mingling together to form connections and patt erns out of seemingly separated things. The film opens with a close shot side-view of the protagonist's face as he smokes a cigarette, smoke drifting up from his lips and into the surrounding darkness. He is talking, but that soon is faded into the sound of rainwater. The rain becomes visible as it replaces David's face in a fade technique, and David enters the frame and walks from the right of the screen to its left, suggesting change and action. He arrives at a restaurant window, peers in, and falls into a strange conversation with the employees. This is now the chronological middle of the story, and, while common in Medieval literature, is a highly unorthodox place to begin a picture. Though this film is more easily classified as a formalist piece, it has outstanding avant garde elements throughout. The transition from the restaurant to the car is masked by the dialogue covering it. Since the acting overrides editing as a way to convey meaning in Shine, Hicks employs many sound motifs to ease editing transitions and make them seem more natural. As the discussion fades and the rain again takes auditory prominence, the scene darkens and the water becomes the clapping of many hands. In this way David eases into a flashback of his childhood. He walks small and silent to the stage for his first competition, and a long shot is used to emphasise the fright and anxiety of the boy. Other transitory devices include David's glasses, his hands on the piano keys, and sometimes a change in his costume, such as when he first plays the restaurant in rags. When he stands to receive his applause, he is dressed much more nicely, now an employee of the establishment. Hicks also employs classical cutting techniques, which depend on the content curve (the moment when the audience has had a chance to assimilate all information presented but not analyse or become bored with it) to determine breaks in scenes. One example of this technique is after David presents his professor with the Rack III and asks Am I mad enough? The scene is cut before the professor answers, and the following scene is the professor intensively training David on the very piece. Cutting for continuity is commonly used to condense time while maintaining a sense of the actions taking place between two major events. Preparations for one of David's concerts are edited in such a manner, making a ritual out of the ordeal while not wasting too much time on it. Besides editing, relationships can be suggested through film devices such as proxemic ranges, angles, and reaction shots. After David loses his first competition, his father stares at the ground while walking well ahead of the boy. His father is disappointed, and David is rather unaware of any problem as he innocently plays hopscotch as he follows. The reactions of David's father and his instructor are shown through parallel editing when the announcement of the National Champion does not coincide with their hopes for David. Both are displeased, but Mr. Helfgott simmers with barely restrained anger. Since he was denied music as a child, he forces it upon David and demands greatness

The Study of Suicide by Emile Durkheim Le Suicide  by founding sociologist Émile Durkheim is a classic text in sociology that is widely taught to psychology students. Published in 1897, the book was the first to present a sociological study of suicide, and its conclusion that suicide can have origins in social causes rather than just being due to individual temperament, was groundbreaking at the time. Durkheim reasoned that social integration, in particular, is a factor. The more socially integrated a person is- connected to society, possessing of a feeling of general belonging and a sense that life makes sense within the social context- the less likely he or she is to commit suicide. Durkheims Typology of Suicide Durkheim developed a theoretical typology of suicide to explain the differing effects of social factors and how they might lead to suicide: Anomic suicide is an extreme response by a person who experiences anomie,  a sense of disconnection from society and a feeling of not belonging resulting from weakened social cohesion. Anomie occurs during periods of serious social, economic, or political upheaval, which result in quick and extreme changes to society and everyday life. In such circumstances, a person might feel so confused and disconnected that they choose to commit suicide.​Altruistic suicide is often a result of excessive regulation of individuals by social forces such that a person may be moved to kill themselves for the benefit of a cause or for society at large. An example is someone who commits suicide for the sake of a religious or political cause, such as the infamous Japanese Kamikaze pilots of World War II, or the hijackers that crashed the airplanes into the World Trade Center, the Pentagon, and a field in Pennsylvania in 2001. In such social circumstances, people are so strongly integrated into s ocial expectations and society itself that they will kill themselves in an effort to achieve collective goals. Egoistic suicide  is a profound response executed by people who feel totally detached from society. Ordinarily, people are integrated into society by work roles, ties to family and community, and other social bonds. When these bonds are weakened through retirement or loss of family and friends, the likelihood of egoistic suicide increases. Elderly people, who suffer these losses most profoundly, are highly susceptible to egoistic suicide.Fatalistic suicide  occurs under conditions of extreme social regulation resulting in oppressive conditions and a denial of the self and of agency. In such a situation a person may elect to die rather than continue enduring the oppressive conditions, such as the case of suicide among prisoners.
